VACATION RENTALS COMPANY S.L., es una sociedad limitada, con C.I.F.: B57648826 y con
domicilio social en la Plaza del Príncipe número 3, 1er piso, de Mahón, MENORCA (07702) ESPAÑA.
VACATION RENTALS COMPANY S.L. es propietaria del sitio web COME2MENORCA.COM.
VACATION RENTALS COMPANY, no es una empresa inmobiliaria o gestora de estancias
turísticas en viviendas, se trata de una empresa de intermediación turística o central de reservas cuya
actividad consiste principalmente en reservar servicios turísticos de alojamiento de forma individualizada,
mediante la promoción, marketing y publicidad realizada en el dominio www.come2menorca.com.
Si usted como PROPIETARIO decide insertar, promocionar y publicitar su propiedad en
nuestra Web, implicará la aceptación de las siguientes cláusulas, aceptando quedar vinculado por estas
condiciones, mientras permanezca su propiedad publicada en nuestra página Web COME2MENORCA, las
cuales reconoce haber leído y entendido.
VACATION RENTALS COMPANY S.L. no tiene responsabilidad alguna, ante el PROPIETARIO
o INQUILINO, en lo que se refiere al contenido de los acuerdos, contratos de alquiler, obligaciones
o compromisos, a los que puedan convenir el PROPIETARIO-ARRENDADOR y el INQUILINO-
ARRENDATARIO, en el momento de formalizar un arrendamiento.
VACATION RENTALS COMPANY S.L., certifica el cumplimiento de lo dispuesto en los preceptos
5 y 6 de la Ley Orgánica 15/1999 de 13 de diciembre, sobre Protección de Datos de Carácter Personal, y
se compromete a no divulgar, o comerciar con otras entidades ajenas a la empresa, ninguna información
personal que se nos facilite para llevar a cabo nuestra actividad.
CLÁUSULAS
1.- El PROPIETARIO autoriza a VACATION RENTALS COMPANY S.L., a publicitar, promocionar
y a realizar el proceso de reserva de su propiedad por medio de nuestra Web www.come2menorca.com,
además de difundir los datos, detalles e imágenes de su propiedad que él mismo nos haya facilitado para
ser usadas con la citada finalidad.
2.- VACATION RENTALS COMPANY S.L., garantiza que la mencionada información va a ser
utilizada con el único objetivo de promocionar o publicitar la propiedad a través de Internet.
3.- La Web www.come2menorca.com contiene un sistema de reservas que permite realizar las
reservas de un modo directo realizando el pago de la misma por Tarjeta de Crédito o por transferencia,
quedando formalizado el arrendamiento en ese momento. Esta inmediatez con valor formal para el
ARRENDATARIO, obliga al PROPIETARIO a garantizar esta disponibilidad, por lo que se requiere el
establecimiento de ciertas condiciones, con el fin de evitar conflictos de solapamiento de reservas.
4.- El PROPIETARIO tendrá libre disposición de su propiedad para poder ocuparla por su parte
y poder ofrecerla a través de otros medios distintos a nuestra Web, con la obligación de comunicar la
posible ocupación de un período, detallando las fechas de entrada y salida, para que VACATION RENTALS
COMPANY tenga conocimiento de ello y pueda proceder al bloqueo de las mismas en el calendario.
5.- La comunicación, por parte del PROPIETARIO, deberá efectuarse a través de
www.come2menorca.com mediante la introducción de la reserva cuyo contenido deberá incluir los datos
del PROPIETARIO indicando en el apartado de comentarios el texto “RESERVA DEL PROPIETARIO”.
6.- En caso de solapamiento de dos reservas, tendrá validez y predominará sobre otras posibles
opciones, cualquier reserva realizada con anterioridad a la recepción de la comunicación o aviso de
ocupación, por VACATION RENTALS COMPANY a través de la Web www.come2menorca.com.
7.- Las tarifas o precios que se ofrecen en nuestra Web, en relación a la propiedad, serán fijadas
por el PROPIETARIO a tenor de precio por noche de alojamiento, para cada una de las diferentes
temporadas, no pudiendo VACATION RENTALS COMPANY cambiarlas, u ofrecer descuentos sobre las
mismas, sin la precedente aprobación del PROPIETARIO.
8.- Al importe total de la estancia, se le añadirá un importe de 35€ en concepto de limpieza.
9.- Las temporadas serán las a continuación, expuestas:
*Temporada Baja:01/10 hasta 31/05
*Temporada Media:01/06 hasta 30/06 y 01/09 hasta 30/09.
*Temporada Alta:01/07 hasta 31/07
*Temporada Extra:01/08 hasta 31/08
10.- VACATION RENTALS COMPANY, obtendrá una comisión del 20% (más el correspondiente
I.V.A.) por servicios realizados de promoción, publicidad al contratar una reserva por medio de su pagina
web.
11.-El PROPIETARIO se compromete a no ofrecer la propiedad, mediante otros medios, por un
precio inferior a las TARIFAS FINALES pactadas con VACATION RENTALS COMPANY, que puedan
suponer una competencia desleal con la oferta ofrecida para la misma propiedad desde nuestra Web.
12.- El ARRENDATARIO, cuando realice una reserva, abonará el 30% del precio total del
arrendamiento. De este importe VACATION RENTALS COMPANY percibirá su retribución, en el
momento de formalizar la reserva.
13.- La reserva del inmueble objeto de arrendamiento quedará formalizada cuando el
ARRENDATARIO haga efectivo el pago del 30% del total del arrendamiento (IVA incluido).
14.- El importe restante del arrendamiento se abonará por parte del ARRENDATARIO-
INQUILINO directamente al PROPIETARIO en la forma que este convenga en el documento contractual
que remitirá al ARRENDATARIO.
15.- VACATION RENTALS COMPANY, en el momento de la reserva, remitirá de forma
automática por correo electrónico al ARRENDATARIO, un documento de confirmación, que incluirá el
precio, las fechas reservadas, la dirección y la localización de la propiedad, y a partir de ese momento
el PROPIETARIO quedará contractualmente vinculado con el ARRENDATARIO, y deberá garantizar la
disponibilidad de su propiedad en ese período.
16.- VACATION RENTALS COMPANY, dentro de las 48 horas siguientes a la realización
de la reserva, remitirá al ARRENDATARIO y al PROPIETARIO, el contrato de arrendamiento entre
PROPIETARIO y ARRENDATARIO, utilizando el modelo previamente autorizado por el PROPIETARIO.
El contrato de arrendamiento deberá contar con los datos personales y dirección del ARRENDATARIO y
del PROPIETARIO, las fechas e importes del arrendamiento, y los datos de las personas de contacto de la
propiedad, y el resto de cláusulas y condiciones que el PROPIETARIO considere necesarias su inclusión.
17.- VACATION RENTALS COMPANY, con cada nueva reserva remitirá mediante correo
electrónico al PROPIETARIO, los detalles de la misma, los datos del ARRENDATARIO, la documentación
contractual relacionada con la reserva, así como, el calendario actualizado, la relación de las reservas
acumuladas a través de nuestra Web www.come2menorca.com
18.- Con carácter mensual VACATION RENTALS COMPANY S.L., remitirá mediante correo
electrónico al PROPIETARIO, factura formal de los importes acumulados en el mes anterior, en su caso,
por las reservas realizadas en el período.
19.- El PROPIETARIO a su vez, se compromete a tener su propiedad disponible, libre, limpia y
en óptimas condiciones de uso y habitabilidad, en los periodos en que VACATION RENTALS COMPANY,
le haya comunicado que ha sido reservada, siendo el PROPIETARIO, el único responsable frente al
ARRENDATARIO.
20.- El PROPIETARIO asume cualquier responsabilidad y responderá de cualquier tipo de
reclamación por parte del ARRENDATARIO o AUTORIDADES, relacionada con la deficiencia de la calidad
o los servicios de la casa, incidencias durante su estancia u otros problemas de convivencia o de diferente
naturaleza.
21.- El PROPIETARIO se compromete a disponer de una póliza de seguro de Responsabilidad
Civil, que cubra posibles reclamaciones sobre acontecimientos o incidencias ocurridas durante la estancia
del ARRENDATARIO, asumiendo cualquier responsabilidad al respecto.
22.- Nuestra política de cancelación, permite al ARRENDATARIO, la cancelación de la reserva
hasta 60 días antes de su llegada. Dentro de este período, si VACATION RENTALS COMPANY puede
volver a alquilar la vivienda, entonces devolverá todo lo abonado a excepción de 100,00 € en concepto de
gastos de cancelación. Transcurrido el mencionado período el ARRENDATARIO perderá todo derecho
sobre el importe abonada en concepto de reserva a favor de VACATION RENTALS COMPANY, S.L.
23.- VACATION RENTALS COMPANY, no puede garantizar que el ARRENDATARIO, aun
habiendo abonado la reserva, no se persone el día de la entrega de llaves. En tal caso, para evitar
esta posible situación, el PROPIETARIO podrá incluir cláusulas en el documento contractual con el
ARRENDATARIO que le permita añadir otras medidas de garantía.
Llegado el caso, el PROPIETARIO no podrá reclamar a VACATION RENTALS COMPANY
responsabilidad alguna sobra la mencionada circunstancia, fuera del control de la gestión de VACATION
RENTALS COMPANY.
24.- A efectos de archivo, VACATION RENTALS COMPANY, conservará una copia de los
Contratos privados celebrados entre el PROPIETARIO y el ARRENDATARIO, comprometiéndose a su
custodia y a su no difusión a terceros.
25.- El PROPIETARIO se compromete a cumplir con la legislación vigente, en lo relativo al
arrendamiento entre particulares, normas turísticas que puedan ser aplicables, u otra legislación de ámbito
municipal, autonómico, nacional o de tránsito de viajeros. Y exime a VACATION RENTALS COMPANY, de
cualquier responsabilidad relacionada con incumplimientos formales o legales o carencias en su propiedad.
26.- El PROPIETARIO podrá solicitar la exclusión de su propiedad de nuestra Web, a través
de una solicitud remitida por correo electrónico a la dirección info@come2menorca.com . VACATION
RENTALS COMPANY, procederá en el plazo de 48 horas siguientes a la remisión de la solicitud, con la
baja, y le facturará los importes pendientes acumulados hasta la fecha.
27.- De todas las reservas contratadas para su propiedad con anterioridad al momento de la
recepción del correo solicitando la eliminación de su propiedad de nuestra Web, deberá responder el
PROPIETARIO, siendo este el único responsable ante el ARRENDATARIO.
28.- El incumplimiento de cualquiera de las cláusulas anteriores por parte del PROPIETARIO,
habilitará a VACATION RENTALS COMPANY a concluir unilateralmente el acuerdo de colaboración con el
PROPIETARIO, y en consecuencia a eliminar su propiedad de nuestra página Web.
29.- En caso de existir discrepancias en la interpretación del presente acuerdo, ambas partes se
someten a la jurisdicción de los Tribunales de la ciudad de Mahón (Menorca).

VACATION RENTALS COMPANY, is not a real estate company or manager of
touristic stays in houses, it is a tourist brokerage firm or central reservation which is
engaged mainly in tourist accommodation booking services individually, by promoting,
marketing and advertising www.come2menorca.com made in the domain.
If you as the owner decides to add, promote and advertise your property on our site,
will constitute acceptance of the following terms, agreeing to be bound by these
conditions, as long as your property published on our website COME2MENORCA,
which acknowledges having read and understood.
VACATION RENTALS COMPANY SL no liability whatsoever, to the owner or
tenant, in regard to the content of the agreements, leases, obligations or commitments,
which may be agreed between the owner-landlord and tenant-lessee at the time of
formalizing a lease.
VACATION RENTALS COMPANY SL, certifying compliance with the provisions
of the precepts 5 and 6 of Law 15/1999 of 13 December on Protection of Personal
Data, and agrees not to disclose, or trade with other entities outside the company, any
personal information you provide to us to conduct our business.
CLAUSES
1. - The OWNER authorizes to VACATION RENTALS COMPANY SL,
to advertise, promote and make the process of booking your property through our
Web www.come2menorca.com, besides disseminating data, details and images of his
property that have been provided for use with the above purpose for the owner.
2. - VACATION RENTALS COMPANY SL guarantees that such information
will be used for the sole purpose of promoting or advertising the property over the web
site www.come2menorca.com .
3. - The website www.come2menorca.com contains a reservation system that
allows making reservations directly making a payment of the same by Credit Card or by
transfer, lease being finalized at the time. This immediacy with formal value for tenants,
forcing the owner to ensure this availability, so it is necessary to establish certain
conditions, in order to avoid conflicts of overlapping bookings.
4. - The owner shall freely dispose of their property in order to occupy it by
you and to offer it through means other than our website, with the obligation to report
the possible occupation of a period, detailing the dates of entry and exit, VACATION
RENTALS COMPANY to be aware and to proceed to lock them in the calendar.
5. - Communication by the OWNER shall be through www.come2menorca.com by entering the reservation whose contents must include the owner's data indicating in the Comments text "OWNER'S BOOK".
6. - In case of overlap of two reserves, shall be valid and shall prevail over other
options, any reservation made in advance of receipt of the communication or notice of
occupation, VACATION RENTALS COMPANY via Web www.come2menorca.com .
7. - The rates or prices offered on our site, in relation to property, shall be fixed
by the owner on the basis of price per night of stay, for each of the different seasons,
VACATION RENTALS COMPANY can not change, or offer discounts on them,
without the previous approval of the owner.
8. - The total amount of the stay will be added an amount of 35 € for the
cleaning.
9. - The seasons will be then displayed:
* Low season: 01/10 to 31/05
* Mid season: 01/06 to 30/06 and 01/09 to 30/09.
* High season: 01/07 to 31/07
* Extra Season: 01/08 to 31/08
10. - VACATION RENTALS COMPANY, will get a commission of 20% (plus
the corresponding VAT) for services performed promotional advertising to recruit a
reservation through their website.
11.-The OWNER agrees not to offer the property by other means, for a price
lower than the final tariffs agreed with VACATION RENTALS COMPANY, which
may result in unfair competition with the supply offered for the same property from our
website.
12. - The lessee, when you make a reservation, pay 30% of the total price of the
lease. Of this amount VACATION RENTALS COMPANY receive their pay, at the
time of booking.
13. - The reservation of leased property where the lessee shall be expressed
actual payment of 30% of the lease (including VAT).
14. - The remaining amount of the rent will be paid by the tenant directly to
LANDLORD-TENANT in the manner agreed in this contract document to be sent to
the tenant.
15. - VACATION RENTALS COMPANY, at the time of booking,
automatically sent by email to the lessee, a confirmation document, including the
pricing, the reserved dates, address and location of the property, and from then the
OWNER shall contractually linked with the tenant, and shall ensure the availability of
property in that period.
16. - VACATION RENTALS COMPANY, within 48 hours of making the
reservation, send the tenant and the landlord, the lease between landlord and tenant, in
the format previously approved by the OWNER. The lease must have personal data and
address of the tenant and the owner, the dates and amounts of the lease, and the data of
contact persons for the property, and all other terms and conditions as the owner deems
necessary their inclusion.
17. - VACATION RENTALS COMPANY, with each new book sent by email to
the owner, the details thereof, LESSEE data, contractual documentation relating to the
reservation, and the calendar date, the ratio of accumulated reserves through our Web
www.come2menorca.com
18. - In the monthly VACATION RENTALS COMPANY SL, forwarded by
email to the owner, formal invoice amounts accrued in the previous month, where
appropriate, for reservations made in the period.
19. - The owner in turn, agrees to have property available free, clean and in
good condition for use and occupancy in the periods in which VACATION RENTALS
COMPANY, has informed that it has been reserved, being the owner, solely liable to
the tenant.
20. - The owner assumes all liability and liable for any claim by the lessee or
authorities, relating to the impairment of the quality or home services, incidents during
their stay or other problems of coexistence or of a different nature.
21. - The owner agrees to have a policy of liability insurance, to cover potential
claims on events or incidents that occurred during the stay of the LESSEE, assuming
any responsibility.
22. - Our cancellation policy allows the lessee, the cancellation of the
reservation until 60 days before arrival. Within this period, if VACATION RENTALS
COMPANY can re-rent the unit, then return everything paid except of 100.00 € for
cancellation fees. After this time period, the LESSEE shall lose all rights to the amount
paid for the reservation for VACATION RENTALS COMPANY, SL
23. - VACATION RENTALS COMPANY can not guarantee that the tenant,
even having paid the reservation, no persone the day of handover. In this case, to avoid
this possible situation, the owner may include clauses in the contract document with the
tenant that allows adding other security measures.
Where appropriate, the landlord can not claim responsibility VACATION RENTALS

27. - For all reservations property contracted for prior to the time of receipt of
the email requesting the removal of property from our website, the owner is the only
liable.
28. - The breach of any of the above clauses by the OWNER, VACATION
RENTALS COMPANY empower unilaterally conclude the agreement with the owner,

29. - In case of any discrepancy in the interpretation of this agreement, both
parties submit to the jurisdiction of the courts of the city of Mahon (Menorca).
